Background to the birth injury claim
Our client, who we shall call ‘S’, sustained a brachial plexus injury during his birth. This arose as a result of a shoulder dystocia.
As a baby, S was seen by physiotherapy and paediatric specialists, but he was discharged without full resolution of his symptoms, and crucially, without a referral to a children’s orthopaedic specialist.
Growing up, S endured ongoing difficulties, including pain and restricted movement. At the age of 6, S was diagnosed with a dislocated shoulder, which required complex surgery to correct, followed by a gleno-plasty. In his teenage years, he required further surgery on the muscles in his rotator cuff. Despite these procedures, his injury left him with a permanent loss of movement in his arm. This has impacted his everyday life, limiting the sports he can take part in.

Caroline instructed an independent Trauma and Orthopaedic expert to review the case. The expert identified a breach of duty in the hospital’s/doctor’s failure to refer S to a children’s orthopaedic specialist following his birth. The delay in referral to a specialist meant that he missed opportunities for treatment that could have improved his outcome. Given the time that had passed, further improvements in movement were now very unlikely.
Caroline was able to negotiate a compensation settlement of £120,000, without the need for stressful court proceedings.
